What are the basic requirements for a Gay Partner Visa?

  • You must be of the minimum legal age (18 in most cases under Australian law).
  • You must be in a recognized life partnership with an Australian citizen, permanent resident, or eligible New Zealand citizen for at least 12 months.  The 12-month relationship requirement may be waived if you can demonstrate compelling and compassionate circumstances, such as if cohabitation was not permitted under the law of the country where you lived for the 12 months before you applied for your Interdependency Visa.
  • Your relationship with your partner must be genuine and continuing. 
  • You and your partner must show a mutual commitment to a shared life to the exclusion of all others.  
  • You and your partner must be living together or, if not, any separation must be only temporary.  
  • You must be in a serious, long-term relationship and must remain in the partnership with your Australian sponsor during the provisional visa validity period.
  • Your Australian partner must agree to sponsor you and provide a legal undertaking to support you during your first two years in Australia, should you not be able to support yourself.
  • You are required to satisfy health and character requirements.
  • You can apply for the Partner Visa from either in or outside Australia.  If you are applying for the provisional Partner Visa while you are in Australia, you must also hold a valid substantive visa and be in Australia at the time the visa is granted. You must be in Australia when both the provisional and the permanent visas are granted.
  • If you are applying for the provisional Partner Visa while you are outside Australia, you must be outside Australia when the provisional Partner Visa is granted.  You may be in or outside of Australia when your permanent Partner Visa is granted.
